Terms of Service

1. Acceptance of Terms

By accessing or using Servlin ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all visitors, customers, contractors, and other users.

By clicking "I Agree," "Accept & Continue," creating an account, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service.

2. Description of Service

Servlin is an online home service request platform that connects customers ("Customers") with independent local home service providers ("Contractors"). Servlin facilitates introductions only. We are not a home services company, do not employ contractors, and do not perform any home services ourselves.

Contractors may include licensed, insured, verified, or unverified service providers. Unless explicitly stated on a service provider's profile, Servlin does not independently verify licensing, insurance, certifications, qualifications, or background information.

Service Availability

Servlin currently operates in selected locations within the United States. Service availability may vary by state, city, ZIP code, provider availability, and service category. Servlin does not guarantee that services or contractors will be available in any specific geographic area. Servlin may expand, limit, or modify service availability in any location at its sole discretion.

3. Payment Policy

Servlin does not process, hold, or transfer any payments between Customers and Contractors. All payment arrangements — including pricing, payment method, deposits, timing, and disputes — are made directly between the Customer and the Contractor. Servlin has no involvement in and accepts no liability for any financial transactions between users.

• All pricing is negotiated directly between you and the service provider.
• Deposits, invoices, and payment schedules are solely between the customer and service provider.
• Servlin is not responsible for any payment disputes between customers and providers.
• You agree to pay the contractor directly for any services rendered, according to the terms you negotiate with them.

4. Contractor Terms

4.1 Independent Contractor Status

Contractors are independent businesses, not employees, agents, or partners of Servlin. Contractors are solely responsible for their work quality, licensing, insurance, taxes, and compliance with all applicable laws and regulations.

4.2 Contractor Obligations

• Maintain all required licenses, permits, and insurance for your trade and service area
• Accurately represent your qualifications, capabilities, and availability
• Respond to accepted leads promptly and professionally
• Comply with all applicable federal, state, and local laws
• Not engage in discriminatory practices in accepting or performing jobs

4.3 Account Accuracy

Contractors must provide accurate business information during registration. Misrepresentation of credentials, licensing status, or service area is grounds for immediate account termination.

4.4 Contractor Certification and Self-Declaration

By registering as a Contractor, you represent and warrant that all information submitted to Servlin is accurate, complete, and current. You further represent that you possess all licenses, permits, registrations, certifications, and insurance required by applicable law for the services you offer. Contractors are solely responsible for maintaining compliance with all legal and regulatory requirements. Servlin may rely on information provided by Contractors and is under no obligation to independently verify such information.

4.5 Lead Distribution and No Guarantee

Servlin does not guarantee leads, job requests, customers, revenue, business opportunities, response rates, or business growth. Lead distribution may vary based on service area, availability, demand, profile completeness, and platform rules.

5. Customer Terms

• You must be at least 18 years of age and have authority to authorize the requested services at the specified property.
• You agree to provide accurate information in your service request, including a valid phone number and service address.
• You understand that Servlin matches you with available contractors but does not guarantee a match, response time, or job outcome.
• You acknowledge that some service providers may not provide license or insurance information. You are solely responsible for independently verifying a contractor's license, insurance, and qualifications, and for evaluating whether a service provider is appropriate for your needs, before authorizing work.
• Licensing, insurance, permit, registration, and certification requirements vary by state and locality. Customers are responsible for independently verifying that a Contractor satisfies all requirements applicable to their project and location before authorizing work.
• You agree to pay the contractor directly for any services rendered, according to the terms you negotiate with them.

SMS Communications

Servlin may send SMS text messages related to your service requests, provider communications, appointment updates, account notifications, and customer support.

Consent to receive SMS messages is not a condition of purchasing or receiving any service from Servlin. You may opt out at any time by replying STOP. Opting out may limit your ability to receive real-time service updates. Message frequency varies. Message and data rates may apply.

Servlin does not share, sell, rent, or disclose your mobile phone number or SMS consent information to third parties or affiliates for marketing or promotional purposes.

You may opt out of SMS communications at any time by replying STOP to any message. For assistance, reply HELP or contact support@servlin.com.

6. No Endorsement

The inclusion of a Contractor on the Platform does not constitute an endorsement, recommendation, certification, guarantee, or approval by Servlin. Customers are solely responsible for evaluating and selecting a Contractor.

7. User Content

Comments, photographs, and other user-generated content reflect the opinions of users only. Servlin does not verify the accuracy of such content and may remove content at its discretion.

8. Intellectual Property

The Platform, including its software, source code, databases, user interface, design, text, graphics, logos, trademarks, service marks, documentation, and other content (collectively, the "Platform Content"), is owned by Servlin or its licensors and is protected by applicable intellectual property and other applicable laws.

Subject to these Terms, Servlin grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purpose.

Except as expressly authorized in writing by Servlin, you may not:

• Copy, reproduce, distribute, or publicly display any portion of the Platform.
• Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works from the Platform.
• Sell, sublicense, lease, rent, assign, or commercially exploit the Platform or any portion of it.
• Remove or alter any copyright, trademark, or proprietary notices.
• Use Servlin's trademarks, branding, logos, or other intellectual property without prior written permission.

Nothing in these Terms transfers ownership of the Platform or any intellectual property rights to you. All rights not expressly granted are reserved by Servlin.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SERVLIN DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY CONTRACTOR IS LICENSED, INSURED, OR QUALIFIED; (C) THE QUALITY OF SERVICES PERFORMED BY CONTRACTORS WILL MEET YOUR EXPECTATIONS; OR (D) ANY PARTICULAR JOB WILL BE COMPLETED OR COMPLETED SATISFACTORILY.

• Background checks. Servlin does not perform criminal background checks on Contractors unless explicitly stated on the Platform.
• Not an emergency service. Servlin is not an emergency response service. For emergencies involving personal safety, gas leaks, fire, medical emergencies, or criminal activity, contact appropriate emergency services (911) immediately.
• No lead guarantee. Servlin does not guarantee that Contractors will receive any minimum number of leads, jobs, customers, revenue, or business opportunities.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVLIN SHALL NOT BE LIABLE FOR ANY:

• Property damage, personal injury, or death arising from services performed by contractors
• Financial losses arising from contractor non-performance, fraud, or payment disputes
• Indirect, incidental, special, consequential, or punitive damages
• Damages arising from your reliance on contractor credentials displayed on the Platform

To the maximum extent permitted by law, Servlin's aggregate liability to you for any and all claims arising out of or relating to the Platform or these Terms shall not exceed the greater of: (a) $100 USD; or (b) the total amounts you paid to Servlin during the twelve (12) months immediately preceding the event giving rise to the liability. This limitation applies regardless of the cause of action or theory of liability.

11. Indemnification

You agree to indemnify, defend, and hold harmless Servlin and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) services you perform or receive through the Platform; or (d) your violation of any third-party rights.

12. Prohibited Conduct

You may not:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Submit false, misleading, or fraudulent service requests or contractor profiles
• Circumvent the Platform by soliciting or accepting direct payments that bypass agreed terms
• Harass, threaten, or abuse other users
• Attempt to reverse-engineer, scrape, or interfere with the Platform's operation
• Use the Platform to send unsolicited commercial messages

13. Account Termination

Servlin reserves the right to suspend or terminate any account at any time, with or without notice, for violations of these Terms, fraudulent activity, or for any reason at our sole discretion.

14. Dispute Resolution

Disputes between Customers and Contractors are solely between those parties. Servlin has no obligation to mediate or resolve such disputes. Any dispute between you and Servlin shall be resolved by binding arbitration administered by the American Arbitration Association in Maricopa County, Arizona, unless applicable law requires otherwise, except that either party may seek injunctive relief in a court of competent jurisdiction.

15. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

16. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or prominent notice on the Platform. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
